Sanitary Expert Report & State Registration Kazakhstan: main definitions

Since July 2010 Kazakhstan is part of Customs Union

As part of the creation of the Customs Union and as a first step towards the standardization of border requirements, the Sanitary Control based on the single list of products and according to common requirements was established in three member states: Russia, Byelarus and Kazakhstan by the Decree No.299 issued by the Customs Union Commission on May 28, 2010.
This Decree which came into force on July 01, 2010 validates the single list that divides products into three parts: products requiring Sanitary expert report, those submitted to the Sanitary Control in form of registration, and Control-free products.

Scope and relevant products

This Decree which came into force on July 01, 2010 validates the single list that divides products into three parts:

  • products requiring the Sanitary Expert report,
  • those subject to the Sanitary Control in the form of registration,
  • and control-free products.

Below there is an extract from the first part of the single list of products whose compliance with common requirements must be certified by the Sanitary Expert report:

  • GMO-free food with the following customs codes: 02-05, 07-09, 11-25, 27-29, 32-34, 35;
  • children's products, except underwear, with the following customs codes: 32, 34, 39, 40, 42-44, 46, 48-5 -, 60-65, 87, 94 and 95;
  • cosmetics except those subject to registration with the customs code 33;
  • textile and footwear with the following customs codes: 39, 40, 42, 43, 50-60;
  • tobacco, customs code 22;
  • products in direct contact with food except those subject to registration, with the following customs codes: 39, 44, 45, 48, 63, 70, 73 and 76 

The second part of the list brings together products that require registration, it essentially consists of the following products:

  • mineral water and alcohol (all wines and spirits), energy drinks;
  • certain foods such as baby products, sports food, raw materials for food additives, products containing additives with active ingredients;
  • foods made of or originated from genetically modified organisms;
  • cosmetics and oral hygiene;
  • disinfectants, insecticides;
  • household products for home maintenance;
  • personal hygiene products, underwear for children;
  • goods in contact with foodstuffs (except kitchenware, tableware, industrial equipment);
  • food and beverage, preservatives, food additives, additives with active ingredients.
  • materials and equipment in direct contact with food or skin, whose released vapours can be inhaled (cosmetics, textiles, toys, food processing machinery, water treatment units, packaging materials,some furniture, detergents and certain household appliances, chemicals and petrochemicals for industrial application;
  • all types of products for children, including toys, exercise equipment, stationery, prams and strollers, schoolbags, polymers and synthetic materials used in manufacturing products for children.

The third part of the single list of Decree No. 299 issued by the Customs Union Commission on May 28, 2010 lists those products which are not subject to sanitary control. These are:

  • samples for the sanitary and epidemiological expertise;
  • tobacco accessories;
  • laboratory products: chemical reagents, glassware (except ionizing radiation sources);
  • raw materials (chicken and goose eggs, etc.) for scientific research (broth culture);
  • car spares, industrial equipment (except those that have a risk of radioactive contamination);
  • spares and accessories for computer equipment, electronics, electrical appliances that do not have contact with food;
  • collectibles, cosmetic and photo accessories;
  • products manufactured in the territory of the Customs Union but for the market outside its borders;
  • goods for exhibitions, promotional samples which are not intended for sale or marketing in the territory of the Customs Union;
  • products that have been used including those distributed through appropriate outlets;
  • collectibles made by pupils and students of educational institutions within the national and international contests.

Before placing on the market, the manufacturer or its agents shall:
Meet the sanitary requirements of the Customs Union
  • provide the technical file
  • provide the instructions
  • apply the procedures for sanitary control
  • obtain the registration certificate / or Sanitary control and ensure that it is enclosed to the products 
In practice, the original of the Sanitary expert report / registration certificate or its copy is required upon entry of products on the Russian market, namely at the moment of customs clearance in Russia and subsequently, to accompany the product at the point of sale and / or its placing on the market.

Registration Certificate

Applicable procedures

Sanitary expert report about products compliance with health requirements of the Customs Union is issued by authorized centres in member states. Several products of the same family can be grouped into one sanitary expert report.
 
As for registration, the criteria which allow grouping several multiple products are more restricted.

The registration procedure includes following steps:

  • evaluation of technical and administrative file provided by the manufacturer, especially the analysis of product compliance, manufacturing conditions, health standards;
  • carrying out appropriate tests: toxicological, clinical and others, depending on the type of product;
  • compilation of sanitary expert report about products compliance based ontest results and documents analysis;
  • recording of data related to the product as well as its manufacturer in the unique sanitary database of the customs union;
  • issue of product registration certificate.
Evidenceof Sanitary Control (Sanitary expert report and Registration Certificate) is valid while controlled products are circulating in the territory of the Customs Union.
